DISPOSITION: The Commission decided by a vote of 6-0 to approve the proposed letter in MUR 5787, as recommended in the General Counsel?s Memorandum dated October 10, 2008; subject to revision pursuant to the meeting discussion.
The Commission decided by a vote of 6-0 to take the following actions in MUR 5787:
1. Accept the conciliation agreement with Kalyn Free and Kalyn Free for Congress and Loyce Bell, in her official capacity as treasurer; as recommended in General Counsel?s Report #3 dated July 3, 2008.
2. Close the file.
3. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to take the following actions in RAD Referral 05L-38:1. Open a Matter Under Review.2. Find reason to believe that Kalyn Free for Congress and Loyce Bell, in her official capacity as treasurer, violated 2 U.S.C. § 439a(b)(1).3. Find reason to believe that Kalyn Free violated 2 U.S.C. § 439a(b)(1).4. Find reason to believe that Kalyn Free for Congress and Loyce Bell, in her official capacity as treasurer, violated 2 U.S.C. § 434(b)(2), (3) and (8).5. Approve the Factual and Legal Analyses, as recommended in the First General Counsel's Report dated July 31, 2006.6. Approve the use of compulsory process. 7. Approve the appropriate letters, as recommended in the First General Counsel's Report dated July 31, 2006.
