DISPOSITION: The Commision decided by a vote of 4-0 to take the following actions in MUR 5766: 1. Accept the conciliation agreement, as recommended in the General Counsel?s Memorandum dated December 7, 2007. 2. Approve the appropriate letter. 3. Close the file.
The Commission decided by a vote of 4-0 to take the following actions in MUR 5766: 1. Take no further action with respect to Amalgamated Bank and close the file as to this respondent. 2. Take no further action with respect to the Democrat Republican Independent Voter Education ? PAC of the International Brotherhood of Teamsters and C. Thomas Keegel, in his official capacity as treasurer, in connection with 2 U.S.C. § 441b. 3. Enter into conciliation with the Democrat Republican Independent Voter Education ? PAC of the International Brotherhood of Teamsters and C. Thomas Keegel, in his official capacity as treasurer, in connection with 2 U.S.C. § 434(b) prior to a finding of probable cause to believe. 4. Approve the proposed conciliation agreement with the Democrat Republican Independent Voter Education ? PAC of the International Brotherhood of Teamsters and C. Thomas Keegel, in his official capacity as treasurer, as recommended in the General Counsel?s Report dated September 13, 2007; subject to the following revisions: a) Delete Paragraph IV. 9; b) Delete Paragraph VI. 2; and c) Reduce the civil penalty amount to $33,000.00. 5. Approve the Factual and Legal Analyses, as recommended in the General Counsel?s Report dated September 13, 2007; subject to the appropriate deletions and/or revisions pursuant to the meeting discussion. 6. Approve the appropriate letters.
The Commission decided by a vote of 6 - 0 to take the following actions in Audit Referral 06-01: 1.Open a MUR in Audit Referral 06-01. 2. Find reason to believe that Democrat Republican Independent Voter Education - PAC for the International Brotherhood of Teamsters and C. Thomas Keegel, in his official capacity as treasurer, violated 2 U.S.C. §§ 441b and 434(b). 3. Find reason to believe that Amalgamated Bank violated 2 U.S.C. § 441b. 4. Approve as Factual and Legal Analyses the Report of the Audit Division on Democrat Republican Independent Voter Education - PAC for the International Brotherhood of Teamsters dated June 16, 2005. 5.
