Accept the conciliation agreement with American Society of Anesthesiologists PAC and Richard Barwacz, in his official capacity as Treasurer, as recommended in the General Counsel's Report dated May 22, 2006. 2. Approve the appropriate letter. 3. Close the file.
The Commission decided by a vote of 6 - 0 to take the following actions in RAD Referral 05L-18:1. Open a MUR in RR 05L-18.2. Find reason to believe the American Society of Anesthesiologists PAC and Richard Barwacz, in his official capacity as Treasurer, violated 2 U.S.C. § 434(g)(2)(A) and 11 C.F.R. § 104.4(b)(2). 3. Enter into conciliation with the American Society of Anesthesiologists PAC and Richard Barwacz, in his official capacity as Treasurer, prior to finding a probable cause and approve the conciliation agreement, as recommended in the First General Counsel's Report dated April 3, 2006. 4. Approve the Factual and Legal Analysis, as recommended in the First General Counsel's Report dated April 3, 2006. 5. Approve the appropriate letter, as recommended in the First General Counsel's Report dated April 3, 2006.
