SUBJECT: Contributions-Limitations; Contributions-Excessive; Loans
DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 5685:
1. Accept the signed joint conciliation agreement with Joe Turnham for Congress, and Pete Turnham in his official capacity as treasurer, Joseph R. Turnham and Pete Turnham, as recommended in the General Counsel?s Report #3
dated November 6, 2006.
2. Approve the appropriate letters.
3. Close the file.
The Commission decided by a vote of 5-1 to take the following actions in MUR 5685:
1. Take no further action with respect to BancorpSouth Bank and close the file as to this respondent.
2. Take no further action with respect to Joe Turnham for Congress and Pete Turnham, in his official capacity as treasurer, in connection with the bank loan.
3. Take no further action with respect to Joseph R. Turnham in connection with the bank loan.
4. Enter into conciliation with Joe Turnham for Congress and Pete Turnham, in his official capacity as treasurer, in connection with 2 U.S.C. § 441a(f) prior to a finding of probable cause to believe.
5. Enter into conciliation with Joseph R. Turnham in connection with 2 U.S.C. § 441a(f) prior to a finding of probable cause to believe.
6. Approve the proposed global conciliation agreement with Joe Turnham for Congress and Pete Turnham, in his official capacity as treasurer, Pete Turnham and Joseph R. Turnham.
7. Approve the appropriate letters.
The Commission decided by a vote of 4 - 1 to take the following actions in Audit Referral 05-05:
1. Open a MUR.
2. Find reason to believe that Joe Turnham for Congress and Pete Turnham in his official capacity as treasurer violated 2 U.S.C. §§ 441a(f) and 441b(a).
3.Find reason to believe that BancorpSouth Bank violated 2 U.S.C. § 441b(a).
4.Find reason to believe that Joseph R. Turnham violated 2 U.S.C. §§ 441a(f) and 441b(a).
5. Find reason to believe that Pete Turnham violated 2 U.S.C.
§§ 441a(a)(1)(A) and (a)(3).
6. Enter into conciliation with Pete Turnham prior to a finding of probable cause to believe.
7. Approve as Factual and Legal Analyses the Report of the Audit Division on Joe Turnham for Congress Committee dated
August 8, 2005.
8. Approve the conciliation agreement for Pete Turnham, as recommended in the First General Counsel?s Report dated
October 28, 2005.
9. Approve the use of compulsory process in this matter, including the issuance of appropriate interrogatories, document subpoenas, and deposition subpoenas, as
necessary.
10. Approve the appropriate letters.
