DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 5659:1. Accept the conciliation agreement with the Democratic Party of Hawaii and Lynn Matusow, in her official capacity as treasurer, as recommended in the General Counsel's Report #2 dated January 11, 2007.2. Close the file.3. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to close the file as to James Kometani and Colin Veitch, as recommended in the General Counsel's Memorandum dated May 24, 2005.
The Commission decided by a vote of 5-1 to take the following actions in Audit Referral #04-07:1. Open a MUR.2. Find reason to believe that the Democratic Party of Hawaii and Yuriko Sugimura, in her official capacity as treasurer, violated 2 U.S.C. § 441b(a).3. Find reason to believe that the Democratic Party of Hawaii and Yuriko Sugimura, in her official capacity as treasurer, violated 2 U.S.C. § 441a(f).4. Find reason to believe that the Democratic Party of Hawaii and Yuriko Sugimura, in her official capacity as treasurer, violated 2 U.S.C. § 434(b)(4)(H)(v) and 11 CFR § 104.10(b)(4).5. Find reason to believe that Colin Veitch violated 2 U.S.C. § 441a(a)(1)(C), but take no further action and send an admonishment letter.6. Find reason to believe that James Kometani violated 2 U.S.C. § 441a(a)(1)(C), but take no further action and send an admonishment letter.7.
