COMPLAINANT:

DISPOSITION: to take the following actions in MUR 5645:
1. Accept the conciliation agreement with America?s Foundation and Meredith G.
Kelley, in her official capacity as treasurer, as recommended in the General
Counsel?s Report dated March 15, 2007.
Close the file.
Approve the appropriate letters.
The Commission decided by a vote of 5-0 to take the following actions in MUR 5645:
1. Enter into conciliation with America?s Foundation and Meredith G. Kelley, in her official capacity as treasurer, prior to a finding of probable cause to believe.
2. Approve the conciliation agreement, as recommended in the General Counsel?s Report #6 dated February 2, 2007.
3. Take no further action and close the file as to Santorum 2006 and Gregg R. Melinson, in his official capacity as treasurer.
4. Approve the appropriate letters.
The Commission decided by a vote of 6 - 0 to take the following actions in MUR 5645:
1. Find reason to believe that America?s Foundation and Barbara W.Bonfiglio, in her official capacity as treasurer, violated 2 U.S.C. §§ 441b(a) and 434(b)(3)(A).
2. Find reason to believe that Santorum 2006 and Barbara W. Bonfiglio, in her official capacity as treasurer, violated 2 U.S.C. §§ 441b(a) and 434(b)(3)(A).
3. Approve the Factual and Legal Analyses, as recommended in the General Counsel?s Report #5 dated December 23, 2005.
4. Approve the appropriate letters, as recommended in the General Counsel?s Report #5 dated December 23, 2005.
The Commission decided by a vote of 5 - 0 to take the following actions in MUR 5645:
1. Accept the conciliation agreement and close the file as to Highmark, Inc., as recommended in the General Counsel?s Report dated October 26, 2005.
2. Take no further action and close the file as to George Grode.
3. Approve the appropriate letter.

The Commission decided by a vote of 6-0 to take the following actions in MUR 5645:
1. Enter into conciliation with Highmark, Inc. prior to a finding of probable cause to believe.
2. Enter into conciliation with George Grode prior to a finding of probable cause to believe.
3. Enter into conciliation with Bruce Hironimus prior to a finding of probable cause to believe.
4. Take no further action and close the file regarding David O?Brien.
5. Approve the conciliation agreements, as recommended in the
General Counsel?s Report #2 dated July 13, 2005.
6. Approve the appropriate letters, as recommended in the General
Counsel?s Report #2 dated July 13, 2005.
The Commission decided by a vote of 6-0 to take the following actions in Pre-MUR 420:
1. Open a MUR.
2 Find reason to believe that Highmark, Inc. violated 2 U.S.C.
§§ 441b(a) and 441c(a)(1).
3 Find reason to believe that Bruce Hironimus violated 2 U.S.C.
§ 441b(a).
4.Find reason to believe that George Grode violated 2 U.S.C.
§ 441b(a).
5.Find reason to believe that David O?Brien violated 2 U.S.C.
§ 441b(a).
6.Authorize the use of compulsory process, if it becomes necessary, to investigate the matter, including the use of subpoenas duces tecum, interrogatories, and the authority to conduct depositions, directed to Bruce Hironimus, George Grode, David O?Brien, Megan Martin, and to other witnesses as deemed necessary.
7.Approve the Factual and Legal Analyses, as recommended in the First General Counsel?s Report, dated January 19, 2005.
8. Approve the appropriate letters.
