1. Accept the signed conciliation agreement with Conservative Leadership Political Action Committee and David Fenner, in his official capacity as treasurer, American Target Advertising, Inc., The Viguerie Company, and ConservativeHQ.com, Inc., as recommended in the General Counsel?s Report #7
dated December 7, 2005.
2. Admonish and take no further action with respect to American Automated Mailing, Inc., American Business Information Systems, Inc., SMS Direct Printing, Inc., and Marc Roffman, as recommended in the General Counsel?s Report #7 dated
December 7, 2005.
3. Approve the appropriate letters, as recommended in the General Counsel?s Report #7 dated December 7, 2005.
4. Close the file.
The Commission decided by a vote of 4 - 0 to accept the signed conciliation agreement with Benjamin Hart and close the file with respect to him, as recommended in General Counsel?s Report #4 dated October 27, 2005.
The Commission decided by a vote of 4 - 0 to accept the signed conciliation agreement with Edward Adams and close the file with respect to him, as recommended in General Counsel?s Report #5 dated November 2, 2005.
The Commission decided by a vote of 4 - 0 to take the following actions in MUR 5635:1.Find probable cause to believe that Conservative Leadership Political Action Committee and David Fenner, in his official capacity as treasurer, violated 2 U.S.C. §§ 434(b), 441a(f) and 441b(a).2. Find probable cause to believe that American Target Advertising, Inc., the Viguerie Company, and ConservativeHQ.com, Inc. violated 2 U.S.C. § 441b(a).3. 3.Find reason to believe that Edward J. Adams, Jr., Mark Roffman, and Ben Hart violated 2 U.S.C. §441a(a)(1)(C).
4.Find reason to believe that American Target Advertising, the Viguerie Company, Mail Fund, Inc., ConservativeHQ.com, American Business Information Systems, SMS Direct Printing and American Automated Mailing violated 2 U.S.C. § 441b(a).
5.Approve as Factual and Legal Analyses the Report of the Audit Division on Conservative Leadership Political Action Committee, dated November 18, 2004, as recommended in the General Counsel?s Memorandum dated December 16, 2004.
