DISPOSITION: The Commission decided by a vote of 5-0 to take the actions in MUR 5591: 1. Find no reason to believe that Turner for Congress and Michael Berning, in his official capacity as treasurer, violated 2 U.S.C. ยงยง 441a, 441b, or 434(b). 2. Find no reason to believe that Michael Turner violated the Federal Election Campaign Act of 1971, as amended, or the Commission?s regulations. 3. Take no action against the Montgomery County Republican Party and dismiss the matter as to this respondent on the basis of prosecutorial discretion as outlined in Heckler v. Chaney, 470 U.S. 821 (1985). 4. Close the file. 5. Approve the appropriate letters.
