to take the following in actions in MUR 5573:
1. Accept the conciliation agreements with Westar Energy, Inc.,
Carl M. Koupal, Jr., and Douglass Lawrence, and close the file,
as to these respondents, as recommended in the General Counsel?s Report #2,
dated May 4, 2005.
2. Sever David Wittig and Douglas Lake from MUR 5573, open a new MUR as to
them, and authorize the use of compulsory process to investigate the matter.
3. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to instruct the General Counsel?s Office to open a MUR.
The Commission decided by a vote of 4-2 to: Find reason to believe that Governmental Strategies, Inc., and Richard Bornemann violated 11 CFR § 114.2(f). Enter into pre-probable cause conciliation with Governmental Strategies, Inc., and Richard Bornemann, prior to a finding of probable cause to believe. Approve the proposed Conciliation Agreements, as recommended in the General Counsel?s Report dated September 24, 2004. Approve the Factual and Legal Analyses, as recommended in the General Counsel?s Report dated September 24, 2004.
The Commission decided by a vote of 5-1 to (1) Find reason to believe that Westar Energy, Inc.,..........REDACTED.......... Douglass Lawrence and Carl Koupal violated 2 U.S.C. § 441b(a) and 11 CFR §§ 110.6(b)(2)(ii) and 114.2(f). (2) Enter into pre-probable cause conciliation with Westar Energy, Inc.,............REDACTED..........Douglass Lawrence and Carl Koupal prior to a finding of probable cause to believe. (3) Approve the appropriate letters, including letters to recipient committees requiring disgorgement.
