COMPLAINANT: Democratic Congressional Campaign Committee - Expenditures

SUBJECT: Contributions-Excessive; Contributions-Corporations; Loans; Reporting

DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 5571:1. Dismiss the allegation that Dalton Tanonaka and Tanonaka for Congress and Dalton Tanonaka, in his official capacity as treasurer, violated 2 U.S.C. §§ 434(b), 441a(f) or 441b(a) with the respect to the $4,000 loan Dalton Tanonaka made Tanonaka for Congress.2. Take no further action against Dalton Tanonaka and Tanonaka for Congress and Dalton Tanonaka, in his official capacity as treasurer with respect to the $65,000 loan Dalton Tanonaka made to Tanonaka for Congress.3. Take no further action against Incentive Design Builders, Inc. and Kyle Dong.4. Take no further action against Dalton Tanonaka and Tanonaka for Congress and Dalton Tanonaka, in his official capacity as treasurer with respect to the $11,000 loan Dalton Tanonaka made to Tanonaka for Congress other than to send an admonishment for violating 2 U.S.C. §§ 434(b) and 441a(f).5. Take no further action against Burt Okihara.6. Approve the appropriate letters.7. Close the file.
The Commission decided by a vote of 6 - 0 to take the following actions in MUR 5571:1. Find reason to believe that Dalton Tanonaka knowingly and willfully violated 2 U.S.C. §§ 441a(f) and 441b(a).2. Find reason to believe that Tanonaka for Congress and Dalton Tanonaka, in his official capacity as treasurer, knowingly and willfully violated 2 U.S.C. §§ 434(b), 441a(f) and 441b(a).3. Find reason to believe that Burt Okihara violated 2 U.S.C. § 441a(a)(1)(A).4. Find reason to believe that Incentive Design Builders, Inc. and Kyle Dong violated 2 U.S.C. § 441b(a).5...........................REDACTED...............................6.
