SUBJECT: Contributions-Corporations; Reporting

DISPOSITION: The Commission decided by a vote of 5-0 on an amended pre-meeting tally, to take the following actions in MUR 5517: 1. Accept the conciliation agreement with James R. Stork, Stork Investments, Inc. d/b/a "Stork's Bakery," Stork's Las Olas, Inc., and Jim Stork for Congress and William C. Oldaker, in his official capacity as treasurer, as recommended in General Counsel?s Report #3 dated September 22, 2008. 2. Close the file. 3. Approve the appropriate letters.
The Commission decided by a vote of 4-1, on an amended pre-meeting tally, to take the following actions in MUR 5517: 1. Find probable cause to believe that James R. Stork violated 2 U.S.C. § 441b(a). 2. Find probable cause to believe that Stork Investments, Inc. d/b/a "Stork's Bakery" violated 2 U.S.C. § 441b(a). 3. Find probable cause to believe that Stork's Las Olas, Inc. violated 2 U.S.C. §441b(a). 4. Find probable cause to believe that Jim Stork for Congress and William C. Oldaker, in his official capacity as treasurer, violated 2 U.S.C. §§ 434(b) and 441b(a). 5. Approve the conciliation agreement, as recommended in the General Counsel?s Report dated October 17, 2007. 6. Approve the appropriate letter.
The Commission decided by a vote of 5-1 to take the following actions in MUR 5517: 1. Find reason to believe James R. Stock violated 2 U.S.C. §441b. 2. Find reason to believe Stork Investments, Inc., dba ?Stork?s Bakery? violated 2 U.S.C. §441b. 3. Find reason to believe Stork?s Las Olas, Inc., violated 2 U.S.C. §441b. 4. Find reason to believe Jim Stork for Congress and William C. Oldaker, in his official capacity, as treasurer, violated 2 U.S.C.§§ 434 and 441b. 5. Find no reason to believe Jim Stork for Congress and William C. Oldaker, in his official capacity, as treasurer, violated 2 U.S.C.§ 441d. 6.Approve the factual and legal analysis, as recommended in the First General Counsel?s Report, dated January 28, 2005. 7. Authorize the use of compulsory process in this matter, including the issuance of appropriate interrogatories and deposition and document subpoenas. 8. Enter into conciliation with Stork Investments, Inc., dba ?Stork?s Bakery,? Stork?s Las Olas, Inc., James R. Stork, and Jim Stork for Congress and William C. Oldaker, in his official capacity, as treasurer, prior to a finding of probable cause to believe. 9.Approve the appropriate conciliation agreements with Stork Investments, Inc., dba ?Stork?s Bakery,? Stork?s Las Olas, Inc., James R. Stork, and Jim Stork for Congress and William C. Oldaker, in his official capacity, as treasurer. 10. Approve the appropriate letter.
