DISPOSITION: The Commission decided by a vote of 4-1 to take the following actions in MUR 5492:1. Accept the conciliation agreement, as recommended in the General Counsel?s Report dated October 3, 2006.2. Take no action against Emanuel Cleaver, Cleaver for Congress, Inc. and David Fenley, in his official capacity as treasurer.3. Approve the appropriate letters.4. Close the file.
The Commission decided by a vote of 6-0 to take the following actions in MUR 5492:1. Find reason to believe that Freedom, Inc. and William Carson, in his official capacity as treasurer, violated 2 U.S.C. §§ 433 and 434 by not registering and reporting as a political committee and 2 U.S.C. § 441b(a) by accepting corporate contributions.3. Find reason to believe that Freedom, Inc. and William Carson, in his official capacity as treasurer, violated 2 U.S.C. § 441b(a) by making corporate expenditures. Find reason to believe that Freedom, Inc. and William Carson, in his official capacity as treasurer, violated 2 U.S.C. § 441d(a) by making disbursements for express advocacy communications without complete disclaimers.4.Take no action at this time with regard to Emanuel Cleaver, Cleaver for Congress, Inc. and David Fenley, in his official capacity as treasurer.5...............REDACTED...................6.
