The Commission decided by a vote of 5-0 to take the following actions in MUR 5488: 1. Find reason to believe Brad Smith for Congress and James Bailey, in his official capacity as Treasurer violated 2 U.S.C. §441a(f) by accepting excessive contributions. 2. Find reason to believe Bradley Smith, in his personal capacity as candidate, violated 2 U.S.C. §441a(f) by accepting excessive contributions. 3. Enter into pre-probable cause conciliation with all Respondents. 4. Approve the Factual and Legal Analysis, as recommended in the General Counsel?s Report dated March 3, 2005. 5. Approve the Conciliation Agreement, as recommended in the General Counsel?s Report dated March 3, 2005. 6. Approve the appropriate letters, as recommended in the General Counsel?s Report dated March 3, 2005.
