DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 5432: 1. Accept the conciliation agreement with Stephanie Summers-O?Neal for U.S. Congress and Deborah J. Thornton, in her official capacity as treasurer, as recommended in the General Counsel?s Report #2 dated March 18, 2005. 2. Close the file. 3. Approve the appropriate letters, as recommended in the General Counsel?s Report #2 dated March 18, 2005.
The Commission failed by a vote of 3-2 to: a) Find reason to believe that Stephanie Summers-O?Neal for U.S. Congress and Deborah J. Thornton, in her official capacity as treasurer, violated 2 U.S.C. § 441d. b) Find reason to believe that Stephanie Summers-O?Neal violated 2 U.S.C. § 441d. c) Approve the Factual and Legal Analysis, as recommended in the General Counsel?s Report dated January 14, 2005. d) Enter into conciliation with Stephanie Summers-O?Neal for U.S. Congress and Deborah J. Thornton, in her official capacity as treasurer, and with Stephanie Summers-O?Neal prior to a finding of probable cause to believe. e) Approve the proposed conciliation agreement, as recommended in the General Counsel?s Report dated January 14, 2005, subject to a revised civil penalty of $1000.00; and the appropriate letter.
