DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 5413: 1.Accept the conciliation agreement with Democratic Party of Wisconsin Federal Account and Robert Fyrst, as Treasurer, as recommended in the General Counsel's Report #2. 2.Close the file. 3.Approve the appropriate letter.

Find RTB that the Democratic Party of Wisconsin Federal Account and Robert Fyrst, as treasurer, violated 2 U.S.C. 432(c)(5) and 11 C.F.R. 102.9(b) by failing to maintain the required documentation for disbursements. 3. Find RTB that the Demoratic Party of Wisconsin Federal Account and Robert Fyrst, as treasurer, violated 2 U.S.C. 432(d) by failing to preserve records of disbursments for three years. 4. Approve the Factual and Legal Analysis, as recommended in the First GC Report dated February 11, 2004. 5. Enter into conciliation with the Democratic Party of Wisconsin Federal Account and Robert Fyrst, as treasurer, prior to a finding of PCTB. 6. Approve the conciliation agreement, as recommended in the First GC Report dated February 11, 2004. Assigned MUR 5413
