SUBJECT: Contributions-In the name of another; Contributions-Corporations

DISPOSITION: The Commission decided by a vote of 6 - 0 to take the following actions in MUR 5398:1. Approve the language set forth in Appendix A to be incorporated in the Department of Justice?s misdemeanor criminal plea agreement with David LeBlanc as part of a global settlement, as recommended in the General Counsel's Report #3 dated February 24, 2006.2. Approve the language set forth in Appendix B to be incorporated in the Department of Justice?s felony plea agreement with Donald Boucher as part of a global settlement, as recommended in the General Counsel?s Report #3 dated February 24, 2006.3. Take no further action with respect to Hedy LeBlanc.4. Close the file as to all respondents.
The Commission decided by a vote of 6-0 to take the following actions in MUR 5398: 1. Accept the signed Conciliation Agreement of LifeCare Holdings, Inc. and LifeCare Management Services, LLC, as recommended in the General Counsel?s Report #2 dated May 27, 2005. 2. Take no further action and close the file as to John George and Ann George. 3. Take no further action and close the file as to Leroy Thompson. 4. Approve the appropriate letters.
Decided by vote 6-0 to Pre-MUR 415: 1. Open a MUR. 2. Find RTB that LifeCare Holdings, Inc. violated 2 U.S.C. 441b(a) and 441f and enter into pre-probable cause conciliation. 3. Find RTB LifeCare Management Services, LLC violated 2 U.S.C. 441b(a) and 441f and enter into pre-probable cause conciliation. 4. Find RTB that David LeBlanc knowingly and willfully violated 2 U.S.C. 441b(a) and 441f and enter into pre-probable cause conciliation. 5. Find RTB that Donald Boucher knowingly and willfully violated 2 U.S.C. 441b(a) and 441f and enter into pre-probable cause conciliation. 6. Find RTB that Hedy LeBlanc, John George, Ann George, and Leroy Thompson, violated 2 U.S.C. 441f and enter into pre-probable cause conciliation. 7. Approve the appropriate Factual and Legal Analyses, as recommended in the First GC Report dated December 16, 2003. 8. Approve the use of compulsory process in this matter, including the issuance of appropriate subpoenas and interrogatories to David LeBlanc and Donald Boucher, and the issuance of additional interrogatories, document subpoenas, and deposition subpoenas, as necessary, as recommended in the First GC Report dated December 16, 2003. 9. Approve the appropriate letters, as recommended in the First GC Report dated December 16, 2003.
