DISPOSITION: The Commission decided by a vote of 5 - 0 to take the following actions in MUR 5386:
1. Accept the conciliation agreement, as recommended in the General Counsel?s Report #3 dated October 11, 2005.
2. Close the file.
3. Approve the appropriate letter(s), as recommended in the General Counsel?s Report #3 dated October 11, 2005.
The Commission decided to take the following actions in MUR 5386: 1. Find reason to believe that the International Association of Machinists and Aerospace Workers (?IAMAW?) District Lodges 141 and 142 violated 2 U.S.C. §§ 441b and 441f and 11 C.F.R. §§ 110.4 and 102.6.
2. Enter into conciliation with Machinists Non Partisan Political League (?MNPL?) and Warren Mart, in his official capacity as Treasurer, the International Association of Machinists and Aerospace Workers (?IAMAW?) District Lodge 141, IAMAW District Lodge 141-M, IAMAW District Lodge 142 and IAMAW Local Lodge 1487 prior to a finding of probable cause to believe.
3. Approve the proposed Conciliation Agreement, as recommended in the General Counsel?s Revised Report #2 dated August 2, 2005.
4. Approve the appropriate letter(s), as recommended in the General Counsel?s Revised Report #2 dated August 2, 2005.
The Commission decided by a vote of 6-0 to approve the following actions in MUR 5386:
1.Find reason to believe that MNPL, IAMAW District Lodge 141-M and Local Lodge 1487 violated 2 U.S.C. § 441b and 11 C.F.R. § 110.4.
2.Find reason to believe that IAMAW District Lodge 141-M, Local 1487 and MNPL violated 2 U.S.C. §441f.
3. Approve the appropriate Factual and Legal Analyses, as recommended in the General Counsel's Report dated August 31, 2004.
4. Authorize the use of compulsory process to investigate this matter, including the issuance of subpoenas directed to representatives of the MNPL, District Lodge 141-M and Local Lodge 1487, and appropriate other interrogatories, document subpoenas, and deposition subpoenas, as recommended in the General Counsel's Report dated August 31, 2004.
5. Approve the appropriate letters, as recommended in the General Counsel's Report dated August 31, 2004.
