DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 5349: 1. Accept the conciliation agreement with the Minnesota Democratic-
Farmer-Labor House and Joe Atkins, as treasurer, as recommended in the General Counsel?s Report #2, dated October 25, 2004.2. Approve the appropriate letters 3. Close the file.
The Commission decided by a vote of 5-0 to take the following actions in MUR 5349:
1.Find reason to believe that the Democratic-Farmer-Labor House
Caucus and Paul Rogosheske as treasurer violated 2 U.S.C.
§ 434(a) and enter into pre-probable cause conciliation.
2.Find reason to believe that the Democratic-Farmer-Labor House
Caucus and Paul Rogosheske as treasurer violated 2 U.S.C.
§ 441a(f) in connection with the receipt of excessive contributions
and enter into pre-probable cause conciliation.
3.Find reason to believe that the Democratic-Farmer-Labor House
Caucus and Paul Rogosheske as treasurer violated 2 U.S.C.
§ 441b and 11 C.F.R. § 102.5(a) in connection with transfers of funds between the committee's non-federal and federal accounts and enter into pre-probable cause conciliation.
4.Find reason to believe that the Democratic-Farmer-Labor Party and
Paul Schulte violated 2 U.S.C. § 441a(f), but take no further action other than to send a letter of admonishment.
5.Find reason to believe that individual contributors Vance K.
Opperman and Gerald K. Seck violated 2 U.S.C. § 441a(a)(1)(C),
but take no further action other than to send a letter of admonishment.
6.Find no reason to believe that the Democratic-Farmer-Labor House
Caucus and Paul Rogosheske, as treasurer, or the Democratic-Farmer-Labor Party and Paul Schulte, as treasurer, violated 2 U.S.C.
§ 441a in connection with transfers of funds between the two committees.
7.Approve the appropriate Factual and Legal Analyses, as recommended in the General Counsel's Report dated July 22, 2004.
8.Approve the Conciliation Agreement, as recommended in the
General Counsel's Report dated July 22, 2004.
9.Approve the appropriate letters, as recommended in the General Counsel's Report dated July 22, 2004.
