SUBJECT: Contributions-Limitations; Contributions-Excessive

DISPOSITION: Decided by vote 6-0 to: (1) Open a MUR. (2) Find RTB that Richard Egan violated 2 U.S.C. 441a(a)(3). (3) Enter into conciliation with Richard Egan prior to a finding of PCTB. (4) Approve the conciliation agreement, as recommended in the General Counsel Memorandum dated July 24, 2001, amended as follows: Page 2, Paragraph 4: Insert the following sentence at the end of the paragraph: "Respondent represents that the contributions at issue were made from his personal funds and that no other contributions were made that would count toward the $25,000 limit with respect to 2000 or 1998." (5) Direct OGC to negotiate with the counsel for the respondent and to bring this matter back to the Commission for resolution today. (6) And, further direct the Office of General Counsel, if unable to come to an agreement with the counsel for the respondent, to circulate the original conciliation agreement, as submitted by the respondent's counsel for approval on a tally vote basis. (7) Approve the Factual and Legal Analysis, as recommended in the General Counsel Memorandum dated July 24, 2001. (8) Approve the appropriate letter.
Decided by vote 6-0 to: (1) Approve the conciliation agreement, as recommended in the General Counsel Memorandum dated July 26, 2001. (2) Close the file.
