DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 5155: 1. Take no further action and send a letter of admonishment to Jerome Dewald. 2. Take no further action and send a letter of admonishment to Swing States for a Conservative White House and Marsha McCoy-Pfister in her official capacity as Treasurer. 3. Take no further action and send a letter of admonishment to Friends for a Democratic White House and Jonathon Mosier in his official capacity as Treasurer. 4. Take no further action as to TRKC, Inc. 5. Close the file.
Decided by vote 5-0 to: (1) Find no RTB that Friends for a Democratic White House and Lynn Sammartino, as treasurer, violated 2 U.S.C. 433 and 434. (2) Find no RTB that Friends for a Democratic White House and Lynn Sammartino, as treasurer, violated 2 U.S.C. 441h. (3) Find RTB that Friends for a Democratic White House and Lynn Sammartino, as treasurer, violated 2 U.S.C. 438(a)(4) and enter into conciliation prior to a finding of PCTB. (4) Find RTB that the Swing States PAC and Marsha McCoy-Pfister, as treasurer, violated 2 U.S.C. 438(a)(4) and enter into conciliation prior to a finding of PCTB. (5) Find RTB that Jerome Dewald violated 2 U.S.C. 438(a)(4) and enter into conciliation prior to a finding of PCTB.
Decided by vote 5-0 to: (1) Approve the Factual and Legal Analyses and the appropriate letters for Friends for a Democratic White House and Lynn Sammartino, as treasurer; Swing States PAC and Marsha McCoy-Pfister, as treasurer; and Jerome Dewald, as recommended in the General Counsel Report dated May 21, 2002; subject to any necessary revisions to reflect Lynn Sammartino as the treasurer of Friends for a Democratic White House. (2) Approve the conciliation agreements for Friends for a Democratic White House and Lynn Sammartino, as treasurer; Swing States PAC and Marsha McCoy-Pfister, as treasurer; and Jerome Dewald, as recommended in the General Counsel Report dated May 21, 2002; subject to the following revisions: a) Replace "Patricia Claucherty" with "Lynn Sammartino" as the treasurer in the conciliation agreement for Friends for a Democratic White House; b) Amend the civil penalty amount for each respondent to $10,000; c) Add a requirement to disgorge to the United States Treasury the following amounts: $32,783.21 from the Friends for a Democratic White House; $134,214.79 from the Swing States PAC.
