DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 4999: 1.Accept the conciliation agreement with Edward M. Bernstein and Associates, Inc., Edward M. Bernstein, A Lot of People Supporting Ed Bernstein, and Michael W. Kern, as treasurer, as recommended in the General Counsel's Report #3 dated April 26, 2004. 2.Close the file.3. Approve the appropriate letters, as recommended in the General Counsel's Report #3 dated April 26, 2004.
Decided by vote 4-2 to 1. Approve the subpoena for deposition and production of documents and order to submit written answers to Edward M. Bernstein, as recommended in the GC Report dated September 24, 2003. 2. Approve the subpoena for deposition and production of documents and order to submit written answers to Nancy Bernstein, as recommended in the GC Report dated September 24, 2003. 3. Approve the subpoena for deposition and production of documents and order to submit written answers to Edward Lazarus, as recommended in the GC Report dated September 24, 2003. 4. Approve the subpoena for the deposition of Karl Struble, as recommended in the GC Report dated September 24, 2003. 5. Approve the subpoena for deposition and production of documents and order to submit written answers to James D. "Rick" Welch, as recommended in the GC Report dated September 24, 2003. 6. Approve the subpoena for deposition and production of documents and order to submit written answers to Paul Worlie, as recommended in the GC Report dated September 24, 2003. 7. Approve the subpoena for the production of documents and order to submit written answers to Explosive Media, as recommended in the GC Report dated September 24, 2003. 9. Authorize OGC to exercise discretion, as appropriate, regarding pre-probable cause conciliation discussions. 10. Approve the appropriate letters.
Decided by vote 4-2 to: (1) Find RTB that A Lot of People Supporting Ed Bernstein and Michael W. Kern, as treasurer, violated 2 U.S.C. 441b. (2) Find RTB that Edward M. Bernstein and Associates, and Edward M. Bernstein, as an officer, violated 2 U.S.C. 441b. (3) Approve the appropriate Factual and Legal Analyses, as recommended in the General Counsel Report dated May 22, 2001; as revised, to amend the Factual and Legal Analysis at Attachment #15 by deleting the last sentence (beginning on page 11 of 16 and continuing on page 12 of 16) which reads: "In March, Mr. Bernstein reportedly spent $30,880 on television advertisements in the three Las Vegas network stations." (4) . Approve the appropriate letters, as recommended in the General Counsel Report dated May 22, 2001. (5) Find no RTB that KVBC-TV, KNRV-TV, or Sunbelt Communications violated any provision of the Act in connection with this matter. (6) Approve the discovery directed to Edward M. Bernstein, Explosive Media, Edward M. Bernstein and Associates, Inc., A Lot of People Supporting Ed Bernstein, Media Strategies and Research, and StrubleOppel Communications, as recommended in the GC Report dated May 22, 2001.
