      <description>WASHINGTON &amp;#150; At its open meeting Thursday, the Federal Election Commission (FEC) approved two Notices of Proposed Rulemaking (NPRMs) implementing the D.C. Circuit Court of Appeals Opinion in Shays v. FEC (Shays III)  that found invalid aspects of some of the rules the Commission promulgated to implement the Bipartisan Campaign Reform Act of 2002 (BCRA). The Commission seeks comment on proposed changes to the rules to implement the Shays III decision. The Commission also approved three Advisory Opinions.</description>

      <description>WASHINGTON - The Federal Election Commission announced today that it accepted a conciliation agreement with John Karoly, Jr., Karoly Law Offices, P.C., Jayann Brantley, Heather Kovacs and Christina Ligotti, who are alleged to have played a role in making impermissible contributions to Richard Gephardt&apos;s presidential campaign in 2003. The agreement provides that in order to settle the matter on behalf of all the parties, John Karoly, Jr. and Karoly Law Offices, P.C. will pay a civil penalty of $155,000.</description>

      <description>WASHINGTON&amp;#151;Financial activity by political action committees continued its upward climb in 2007-2008, according to figures compiled by the Federal Election Commission, though at a slower rate than in recent election cycles. From Jan. 1, 2007, through Dec. 31, 2008, PACs raised $1.2 billion, up 10.5 percent over 2005-2006, and spent $1.18 billion, up 11.8 percent over the previous two-year cycle. Comparable growth rates ranged from 18% to more than 30% during 2004 and 2006. Cash on hand as of Dec. 31, 2008, for the 5,210 PACs totaled $308.6 million.</description>

The Federal Election Commission will convene a public hearing at 10 a.m. on Wednesday, Jan. 14, 2009, to hear comments on improving its policies and procedures. The hearing is scheduled to resume on Thursday, Jan. 15, at 10 a.m.&lt;br&gt;
&lt;br&gt;
The Commission has received 25 written comments (link) submitted in response to the questions contained in the Notice of Hearing published in the Federal Register, and more than 200 responses addressing other issues.  Sixteen witnesses, including former FEC Commissioners and legal practitioners with extensive experience in campaign finance law, are scheduled to present oral testimony. Topics are expected to include policy statements, advisory opinions, public information and the compliance and enforcement processes, as well as the procedures contained in the Federal Election Campaign Act of 1971, as amended, and the Commission&apos;s implementing regulations.&lt;br&gt;
&lt;br&gt;
The two-day hearing will be held at the Commission&apos;s offices at 999 E Street, N.W. in Washington.  The schedule of witnesses is available on the FEC Web site.&lt;br&gt;

      <title>ADR Program Resolves Three Cases</title>
      <description>WASHINGTON -- The Federal Election Commission has successfully resolved three enforcement matters through its Alternative Dispute Resolution (ADR) program.&lt;br&gt;
&lt;br&gt;
In ADR 308, the Fortu&amp;#241;o 2004, Inc. committee paid a $1,000 civil penalty for failing to itemize debts and obligations accurately on their 2003 and 2004 campaign financial reports. &lt;br&gt;
&lt;br&gt;
In ADR 318, the Hall for Congress committee paid a $1,000 civil penalty for failing to disclose all financial activity on its 2004 April Quarterly report. &lt;br&gt;
&lt;br&gt;
The Commission dismissed a complaint against the Marty Schwimmer Congressional Committee in ADR 348 because the committee filed its 2006 Pre-Primary Report on time.&lt;br&gt;
&lt;br&gt;
The ADR program has proved very effective in expediting resolution of certain types of violations and reduced the agency&amp;#146;s costs for resolving some enforcement matters. This brings to 281 the total number of cases resolved through the ADR program since it began on October 2, 2000. &lt;br&gt;
&lt;br&gt;
The ADR process is designed to reach an expedient resolution with a mutually agreeable settlement that is in compliance with the Federal Election Campaign Act.  For a case to be considered for ADR treatment, a respondent must express willingness to engage in the ADR process, agree to set aside the statute of limitations while the case is being resolved, and participate in mediation if necessary.  Resolutions are submitted to the Commissioners for final approval.  Closed ADR negotiated settlement summaries are available in the FEC&amp;#146;s Press and Public Records office.&lt;br&gt;
