COMMISSION MEETINGS AND HEARINGS

No Commission open meetings or executive sessions were scheduled this week.

ADVISORY OPINIONS

AO 2013-03 (Bilbray-Kohn). On June 6, the Commission made public a draft of Advisory Opinion 2013-03. The requester asks whether, as a potential candidate for the U.S. House of Representatives, she may serve as a paid consultant to a non-profit corporation that raises and spends non-federal funds.  Public comments on the draft are due by noon on June 12.

ENFORCEMENT

COMPLAINANT: FEC-Initiated
RESPONDENT: Schiff for Senate and Andrew Schiff, in his official capacity as treasurer
SUBJECT: In the normal course of carrying out its supervisory responsibilities, the FEC found that Schiff for Senate and Andrew Schiff, in his official capacity as treasurer, (the Committee) failed to disclose $107,854.07 in a quarterly report. Peter Schiff was a 2010 primary election candidate for Connecticut’s United States Senate seat.
DISPOSITION: The Commission entered into a conciliation agreement providing for the Committee to pay a civil penalty of $2,500.

LITIGATION

Stop This Insanity, Inc., et al. v. FEC (D.C. Cir. No. 13-5008). On June 6, appellants filed a Reply Brief in the United States Court of Appeals for the District of Columbia Circuit.

Wagner v. FEC (Circuit Court Case 12-5365; District Court Case 1:11-cv-01841-JEB). On May 31, the United States Court of Appeals for the District of Columbia Circuit issued a mandate, and the Commission filed a Motion to Recall and Stay Issuance of the Mandate. On June 5, the United States District Court for the District of Columbia issued a certification order. On June 6, the United States Court of Appeals for the District of Columbia Circuit issued a per curiam Order.

RULEMAKING AND AGENCY OPERATIONS

Advance Notice of Proposed Rulemaking on Technological Modernization.  The Commission received comments on the Advance Notice of Proposed Rulemaking on Technological Modernization concerning whether to revise Commission regulations to update or remove references to outdated technologies and whether to revise a variety of regulations to address electronic transactions, including those made by debit cards, credit cards, gift cards, Internet-based payment processing, online banking, and text message.
